Last week we posted about efforts that are under way to try to change Social Security Administration (SSA) rules to speed up disability benefits to terminally ill Americans in North Carolina and the rest of the country.
There is a measure that is before Congress that seeks to waive the usual five-month waiting period before Social Security benefits begin in cases where the recipient suffers from a terminal condition. The bill, if passed, could improve the quality of the final days of these people's lives. But some legal experts say it may not be the only solution. They say benefit lag time could be shortened now by speeding up applications under a critical-case designation. Winning a designation based on having one of the exception conditions for Compassionate Allowance could help, too.
A spokesman for the SSA says that while such provisions can speed up applications, the five-month wait remains. Still, a New Hampshire man who lost a daughter to cancer because of that wait, and who has been pushing for this measure since her death, says she would have benefitted. The thing is, they didn't know their options. As he put it, "If you don't know the right questions to ask, they are not going to tell you the answer."
As true as that may be, it's also true that it helps to go to the right source. Rather than attempting to get information from the general Social Security phone bank, some experts recommend going directly to a regional SSA office. They say that, while SSA officials reject the notion that the 800 number service isn't adequate, going to the regional office is the way to get real help.
There is one other big issue that can muck up the claims process for those seeking faster consideration; the need for medical records. The SSAs doctors have to review the documents. Getting them released can take a lot of time and money - - money the patient often doesn't have. Some states require that records going to SSA for review be provided by doctors at no cost. But not states all do.
Whether a provision to establish a nationwide waiver of record fees is part of the reform legislation before Congress is not clear at the time of this post.
